1. Scope of Application

These General Terms and Conditions (hereinafter referred to as "GTC") apply to all orders placed and contracts concluded via the online shop www.mybikeplan.ch of Mybikeplan AG, headquartered in Zurich (CHE-238.395.624) (hereinafter referred to as "MyBikePlan" or "online shop").

MyBikePlan reserves the right to amend these GTC. The version of the GTC in force at the time of the order shall prevail and cannot be unilaterally modified for that specific order.

2. Offer

The offer is intended for customers residing in Switzerland (hereinafter referred to as "customer(s)" or "you", "your"). Deliveries are only made to addresses within Switzerland.

The offer is valid as long as it is visible in the online shop and/or while stocks last. Price and assortment changes are possible at any time. Images shown in advertisements, brochures, the online shop, etc., are for illustrative purposes only and are not contractually binding.

3. Ordering

The presentation of products in the online shop is not a legally binding request, but rather an online catalog provided without obligation or a non-binding invitation for you to order the product and/or service from MyBikePlan.

An order is considered an offer to MyBikePlan to conclude a contract. After transmitting the order, you will receive an email confirmation of receipt documenting that the order has been received. Once this confirmation is received, you can no longer modify the order and are bound by it.

MyBikePlan is free to refuse all or part of an order without giving a reason. In such cases, you will be informed, and any payments already made will be refunded. Further claims are excluded. Temporarily unavailable products cannot be reserved.

4. Conclusion of Contract

A contract is only concluded once the ordered products have been dispatched or a delivery date has been agreed upon.

The processing of product orders will only occur after:

- You have successfully passed a credit check and obtained a financial commitment from one of our banking partners (e.g., bob Finance, a branch of Valora Switzerland AG, or Heidi Pay, Geneva).

- You have signed a financing agreement with our corresponding banking partner ("Financing Contract") via physical or electronic signature.

- MyBikePlan has sent you the Financing Contract in PDF format via a confirmation email.

5. Prices

Prices are in Swiss Francs (CHF), including Value Added Tax (VAT) and, if applicable, the Advance Recycling Fee (ARF/TAR). The prevailing price is the one in effect at the time of the order.

Discount Codes: Discount codes are exclusively valid for contract terms between 36 and 48 months.

6. Payment

Payments must be made in Swiss Francs. MyBikePlan offers payment by invoice with installment options via our banking partner. MyBikePlan may subject this payment method to a positive credit check and other conditions at its discretion (e.g., minimum age, Swiss residence).

By entering the contract, you acknowledge that a credit check must be performed and that personal data will be stored and transmitted to banking partners for this purpose. In the event of payment by invoice, MyBikePlan assigns the purchase price claim to the respective banking partner. Payment processing is handled by the partner, and the invoice is sent to your provided email. The invoice amount must be paid directly to the banking partner within 20 calendar days of the invoice date. Late payments incur interest and processing fees.

7. Delivery

The delivery address must be in Switzerland. Home delivery generally includes delivery to the first door of your building. Delivery costs are indicated separately in the shopping cart and on the invoice.

If products are delivered with obvious damage to the packaging or content, you must immediately complain to the service provider (e.g., carrier, post office) and refuse acceptance. You are required to obtain a damage confirmation from the provider. All transport damage must also be reported immediately to sales@mybikeplan.ch.

If you do not accept the products on the agreed delivery date, MyBikePlan may charge you for delivery costs and inconveniences and reserves the right to terminate the contract.

8. Delivery Date

Delivery times indicated are indicative and start from the time of the order. A provisional delivery date is provided with the order confirmation. In the event of (partial) delivery impossibility, the order will be canceled, you will be informed, and payments will be refunded. Further claims for delayed or impossible delivery are excluded.

9. Revocation of Financing Contract

MyBikePlan has the right to revoke the contract at any time in the event of a negative entry in the ZEK (Central Office for Credit Information).

You have the right to revoke the Financing Contract in writing within 14 calendar days without charge, or up to 90 calendar days (with fees). The period begins once the contract is signed by both parties.

14–30 days: 250 CHF fee.

30–60 days: 250 CHF fee + 5% of the purchase price.

60–90 days: 250 CHF fee + 10% of the purchase price.

Returning the product follows the rules in Section 12. Traces of wear or use will be billed. The financing contract is only validly terminated once these fees are paid. Revocation implies the immediate return of the products or payment of the full purchase price. Return costs are your responsibility.

10. Right of Return

Returns are possible within 14 calendar days of contract conclusion.

The product must be returned in its original packaging, intact, clean, and complete.

You must notify MyBikePlan in writing (sales@mybikeplan.ch) to organize collection.

Return costs (approx. 100 CHF) are at your expense unless returned to a designated MyBikePlan site (where no fee applies).

If the product has been used (specifically if driven more than 2 km), a deduction for wear and tear will be applied to the refund. Shipping costs are not refunded.

11. Flexible Exchange Right

A flexible exchange is possible within 7 days of receipt. You may exchange the product for another model of the same type in stock (similar or higher price) provided you have not driven more than 2 km (on dry ground). You must pay any price difference in advance. This right can be exercised once per product.

12. Warranty

New products are covered by a two-year manufacturer’s warranty. This covers major manufacturing defects present at the time of delivery.

Exclusions: Normal wear and tear, improper handling, external circumstances (battery power decrease, software errors, lightning, etc.).

MyBikePlan may choose to repair the item, provide an equivalent replacement, or refund the price. Repairs by unauthorized third parties are excluded unless previously agreed in writing.

13. Claims for Defects

Obvious defects must be noted on the delivery note in the presence of the driver. Defective products must be returned immediately with proof of purchase. In the case of a valid warranty claim, return costs are borne by MyBikePlan.

14. Data Protection

Data collected during the contract is used to fulfill the purchase obligation. Data may be shared with service partners (logistics, credit agencies like CRIF, banking partners, debt collection). By accepting these GTC, you consent to this data use.

15. Intellectual Property

All graphics, texts, images, videos, and apps provided by MyBikePlan are protected by copyright. Reproduction, distribution, or reverse engineering is prohibited without prior consent.

16. Applicable Law and Jurisdiction

The legal relationship is governed by Swiss substantive law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

For natural persons: The place of jurisdiction is Zurich or the customer's domicile.

For legal entities: The courts of the Canton of Zurich have exclusive jurisdiction.
